Are property owners legally obligated to pay dues?

The covenants and restrictions, signed when you purchased a lot or home in Bent Oaks, is a legally binding document that the law will enforce. If you do not pay dues, you are assessed an interest penalty of 10%, and you must pay attorney's fees if any are involved in the collection process.

My neighbor does not take care of his lawn. Is there anything I can do?

The covenants and restrictions require each property to be maintained in a neat and attractive manner, including proper cutting of the lawn and trimming of trees and bushes. After notice is given, the Association has the right to pay to have maintenance accomplished, and demand payment for same from the owner.

Is there a rule about how many trees each lot must have?

The Design Standards require that each lot have a minimum of 5 large shade trees (small decorative trees don't count) with a trunk diameter of at least 2 1/2 inches. Of these 5 trees, 3 of them must be located in the front yard.

Is roofing other than wood shingles allowed in Bent Oaks?

The original restrictions allowed for cedar, shake, dimensional cedar wood shingles, slate, or tile.

 

In lieu of these choices, the DRC has pre-approved a number of colors from the GAF Grand Sequoia and GAF Camelot Premium Designer lines of shingles. The most popular color on homes in Bent Oaks is "Weathered Wood Blend," which has a look similar to wood shingles. Contact a member of the DRC for more color choices.

Who do I call for an inoperative street light?

Call Aquila at 800.303.0752, or Emergency Service at 800.303.0357.  The Association is not responsible for the street lights in Bent Oaks.

Why doesn't the Homes Association do anything about the streets?

Bent Oaks has city streets, and the Homes Association is not responsible for maintenance or repairs. Contact the City of Liberty at 781.7100 for repairs and other matters.

What do I do if there is a loose dog in the neighborhood?

Call the City of Liberty at 781.7100. Animal control will have it picked up. The Association is not responsible for stray animals.

My neighbor's dog keeps pooping in my lawn. Can the Homes Association help?

There is a city ordinance requiring that all dogs be kept restrained at all times. Try talking to your neighbor. Click on the Animal Control link at the left for additional information.

Are boats or trailers allowed in Bent Oaks?

Per the restrictions and covenants, no boats or trailers can be parked on any lot unless parked in an enclosed garage. The DRC is authorized to issue a waiver for not more than 48 hours in any 30 day period for a recreational vehicle. Refer to Article XIII, Section 1 (h) of the Covenants, Conditions, and Restrictions of Bent Oaks for detailed information.
